WE ARE IN AI™ – Terms of Use

Please read these Terms of Use (“Terms”) carefully. They govern your access to and use of WE ARE IN AI™’s websites, online forums, platforms, events, digital communications, the Futures by Design Responsible AI Community, and related channels (collectively, the “Website & Network”), which is operated by Innovationist Group LLC (“we,” “us,” or “our”). By accessing or engaging with the Website & Network, including the community, you agree to be bound by these Terms.

WE ARE IN AI™ is a network focused on responsible innovation and artificial intelligence, fostering innovation, critical discourse, and collaboration. The Website & Network includes public websites, online discussions, newsletters, event spaces (physical and virtual), community spaces, and other content platforms (collectively, “Communications”).

By participating, you understand and agree that this is a public forum, and you are responsible for any content you share. You must not share confidential, proprietary, or otherwise restricted material, and you acknowledge that anything you post may be publicly viewed and used for educational purposes.

The Website & Network contains content such as articles, comments, code, graphics, videos, audio, presentations, and other materials (“Content”) provided by WE ARE IN AI™.

All Content provided by WE ARE IN AI™ is proprietary and may only be used in accordance with these Terms. You may not reproduce, distribute, modify, or publicly display any Content without explicit written permission from WE ARE IN AI™.

You may not use any trademarks, logos, or brand assets of WE ARE IN AI™ or any third party without prior written authorization.

All methodologies, frameworks, tools, and proprietary content developed by WE ARE IN AI™, including but not limited to WIN AI™ and SPHERE dimensions, remain the exclusive intellectual property of WE ARE IN AI™.

Accessing content on the Website & Network, attending workshops, participating in the Futures by Design Responsible AI Community, or any other events does not grant any rights, ownership, or license to reproduce, distribute, modify, or publicly display these proprietary materials outside the scope explicitly authorized by WE ARE IN AI™.

All materials shared through the Website & Network, including community content, are provided for educational and informational purposes only. WE ARE IN AI™ does not offer professional, legal, or business advice. You use content and engage with the Website & Network at your own discretion and risk. We do not endorse or verify the claims made by members or third parties.

To the fullest extent permitted by law, you agree to:

• Release WE ARE IN AI™ / Innovationist Group LLC, its organizers, partners, volunteers, and affiliates from any and all liability, claims, demands, damages, losses, or expenses (including legal fees) arising out of or in connection with your participation in the Website, Network , Community, or attendance at any event.
   
• Assume all risk associated with your use of the Website & Network, attendance at events, or reliance on any information or content provided. You understand that participation is voluntary and that all activities and materials are provided “as is” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
   
• Acknowledge that WE ARE IN AI™ / Innovationist Group LLC does not provide, sponsor, endorse, or guarantee any funding, financial support, grants, or investment opportunities in connection with the Website, Network, or events. Attendance or participation only grants you the right to be present or engage — it does not constitute any offer, partnership, or sponsorship arrangement.
   
• Acknowledge that WE ARE IN AI™ / Innovationist Group LLC is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost data, personal injury, property damage, or reputational harm, even if advised of the possibility of such damages.
   
• Indemnify and hold harmless WE ARE IN AI™ / Innovationist Group LLC and its team from any claims, damages, losses, or expenses (including legal fees) resulting from: Your use of the Website & Network, Your Submissions, Your violation of these Terms or any applicable laws or rights of others.

These Terms will remain in effect until terminated by either party. You may terminate these Terms by ceasing all use of the Website & Network and deleting your account (if applicable). We may suspend or terminate your access at any time, with or without notice, if:

• You breach these Terms or the Code of Conduct
• Your conduct creates legal or reputational risk for us or the Network
• We discontinue part or all of the Website & Network
   

Upon termination, the licenses you have granted remain in effect for any Submissions you’ve made publicly available.

We respect the rights of content owners. If you believe that content shared in the Website & Network infringes your copyright, you may submit a notice to hello@weareinai.org with relevant information.

We may update these Terms from time to time to reflect changes in our Website, Network, or the law. If changes are substantive, we will notify you via announcements, banners, or emails. Your continued use of the Website & Network after the effective date of the revised Terms constitutes your acceptance of the updated version.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You agree that the exclusive jurisdiction and venue for any disputes not subject to arbitration shall be in the state or federal courts located in California. WE ARE IN AI™ is a project and trade name of Innovationist Group LLC, and all references to WE ARE IN AI™ in these Terms shall be deemed to include Innovationist Group LLC, its owners, officers, employees, agents, and affiliates.

We reserve the right to modify, reschedule, or cancel any event (including physical and virtual gatherings) at our sole discretion. If an event is changed or cancelled, we will make reasonable efforts to notify registered participants through email or other appropriate means. We are not liable for any costs, damages, or losses (including travel, accommodation, or any other expenses) incurred as a result of such changes or cancellations. Attendance at any event, whether free or paid, grants only the right to participate and does not create any sponsorship, partnership, or funding relationship with WE ARE IN AI™ or Innovationist Group LLC.

Except for claims that may be brought in California small claims court, any dispute, claim, or controversy arising out of or relating to these Terms, the Website & Network, the Membership, or any event shall be resolved exclusively through binding arbitration conducted in the State of California, in accordance with the rules of a recognized arbitration body. The arbitration shall take place in California, and California law shall govern the proceedings, without regard to its conflict of law principles. All disputes shall be between you and Innovationist Group LLC. You and WE ARE IN AI™ / Innovationist Group LLC agree to waive the right to a trial by jury and to participate in a class action or class-wide arbitration.

Any claim or cause of action must be filed within three (3) months after such claim or cause of action arose, or it will be permanently barred.

These Terms will remain in effect until terminated by either party. You may terminate by ceasing all use of the community and deleting your account (if applicable). WE ARE IN AI™ may suspend or terminate your access at any time, with or without notice if:

• You breach these Terms or the Code of Conduct
   
• Your conduct creates legal or reputational risk for us or the community
   
• We discontinue part or all of the community
   

Upon termination, the licenses you have granted remain in effect for any Submissions you’ve made publicly available.

WE ARE IN AI™ may update these Terms to reflect changes in the community or applicable law. Your continued use constitutes acceptance of the revised Terms.
